Kitroser & Associates, in West Palm Beach, Florida, is devoted to ensuring that gay, lesbian, bisexual and transgender individuals and couples are afforded the same protections as their heterosexual contemporaries. The GLBT community faces great societal challenges in nearly every aspect of their lives. Sadly, without careful planning, a partner who has spent years with a beloved individual can face legal roadblocks when providing care, or can be denied access at critical times or even an inheritance.
“In almost every case the law is rock solid. Societal issues pose the greatest threat to GLBT clients. I utilize the exact same practical tools and knowledge irrespective of my client’s sexual orientation. However, I also utilize my experience in confronting legal issues that are for the most part germane only to the GLBT community.” — Attorney Mitchell I. Kitroser
Unlike married heterosexual couples, under Florida law, a same-sex partner does not get the automatic right to obtain private information or make important medical decisions when his or her partner is incapacitated. A same-sex partner also does not automatically inherit assets upon his or her partner’s death like a heterosexual spouse would. Proper and good planning is essential to ensure these rights.
We help clients put in place as many protections as possible to help make certain the couple is treated fairly under the law. We use documents such as durable powers of attorney, HIPPA waivers and health care proxies to guarantee that our client’s partner is afforded access to financial and medical information and has decision-making powers in times of crisis. When necessary, we aggressively advocate for our clients to ensure that their rights and decisions are honored and respected.
Additionally, we work with our GLBT clients in matters involving children. If one partner is the biological parent of a child, the other partner may have no legal rights to that child if the biological parent passes away. In appropriate circumstances, we can set up a standby guardianship, appointing a partner as the standby guardian before an emergency strikes.
In cases of emergency, Kitroser & Associates’s digital document warehousing can be especially useful. This service ensures that your partner has ready access to critical documents that may be required in serious illness and end-of-life situations. The firm is always prepared to stand behind their clients where advocacy is needed to protect and support the plan that has been put in place.
“Anyone can prepare documents. What a client needs is an attorney who will help his clients in an emergency.”
