Can I Pass on My Passive Income in a North Palm Beach Estate Plan?

_Estate Plan__

Passive income is something that some people strive for their entire lives. If you have a portfolio that provides you with excellent passive income, you might want to leave behind this financial security for your loved ones. How easy is it for your loved ones to inherit your passive income system? Can a North Palm Beach estate planning lawyer help in this situation?

A Trust Is the Ideal Way to Preserve Your Passive Income

An obvious solution is to place your passive income system into a trust. If your passive income comes from stock holdings and dividends, you can simply transfer the stocks into a trust without selling them. If your passive income comes from rental properties, you can also transfer these assets into your trust.

The benefit of this approach is that once the portfolio is “locked” inside a trust, your beneficiary cannot liquidate it. Instead, your trustee will have control over your passive income. If you instruct your trustee to never liquidate the portfolio and to preserve the passive income stream.

A trust of this nature would provide your beneficiaries with the passive income in the form of regular distributions. The underlying investment would remain untouched, potentially leading to increased gains.

This approach may be necessary because beneficiaries could otherwise sell the assets that generate passive income. For example, you might leave them $1 million in assets via a basic Will. Even though you might want your beneficiary to preserve the assets and continue receiving the passive income, they may simply liquidate everything and take the cash.

If this happens, your beneficiary could blow through the cash within a few short years. This obviously destroys their financial security long-term, and it is a genuine threat to many beneficiaries who inherit high-net-worth estates.

What About Intellectual Property?

While passive income often takes the form of rental properties and stocks, intellectual property is another possible example. If you earn passive income because of your intellectual property, you should “assign” the rights to your royalties to your beneficiaries. Once you take this step, your loved ones will continue to receive your royalties after you’re gone.

What if I Have a Business?

If your passive income comes from your business, consider reviewing LLC operating agreements and other business documents. If you approach this in the correct way, your loved ones can inherit an economic interest in the property without actually obtaining any voting rights or control. This could be attractive for business owners who want their family to receive a share of the profits without any control over how the business operates.
